The laws dictating the allocation of electors have to be on the books before the election starts. So the states mentioned would literarily need to pass laws before the election that say ‘the legislative can assign electors to whichever candidate it wants ‘.

Good point. But haven’t certain state legislatures passed laws that make it easier for them to ignore the popular vote? Perhaps they just claim that there was a problem with voting integrity and so they will select the electors. Or have their new voting laws only made it harder for certain people to vote?

Our Constitution is fatally flawed and unless at least 2 of the GOP justices exit the Court soon, our future is grim.
