There’s analysis at the link about how the Court might find that the sponsors of the Prop 8 lacked standing to bring suit, and that the Court might remand to trial court for disposition. If that happens, the SSM couples who sued would have to file a summary judgment motion and see if the State defends (a party that would have standing to sue/defend). If the State opts not to defend and the SSM couples win on default, the judge could issue a permanent injunction invalidating the Prop 8.
