Its not that bad. If the Democrats gain control of the Senate and Presidency in the 2020 elections, they can start packing a lot of progressives onto the courts now that blue slips are dead letters.

If they control both houses of Congress and the presidency, they could get real creative and rearrange the courts. They could, for example, split the Ninth Circuit (Scalia did an event at my law school maybe 12 years ago, and said that would only work if you split California between two circuits, and that creates a lot of weird problems that nobody wants to deal with). They could add seats or change the rules for senior status.

I’m not a fan of partisan plays regarding the courts - FDR’s court packing scheme got real push back and he was arguably the most popular president in American history.
