I’m seeing a lot of people lazily compare the Hulk v. Gawker case to that of Erin Andrews. This is patently ridiculous because Hulk wasn’t stalked, he wasn’t in his own paid for hotel room, and nobody involved in this particluar lawsuit had any real fiduciary duty to protect his privacy.

He was at a friends house and was not aware he was being recorded. His privacy was certainly violated illegally and Gawker took advantage of it and profited from it. How would you feel if Gawker had been the ones that released the naked images of Jennifer Lawrence that were obtained through hacking?
