IANAL, but, when I read that statement, I am hearing:
1) That the information that they gathered was from a Foreign Intelligence investigation rather than a Criminal investigation.
As I understand it, the purpose, rules, handling and expectations of the quality of the information associated with a Foreign Intelligence investigation are very different. And are not expected to meet the same standards as those used in a criminal investigation.
And
2) That if a criminal investigation were to occur, it is likely to uncover chargeable offenses, either in a criminal court or in an impeachment trial.
