Prior to any full trial, as CNN explained it, there will be a hearing on whether Zimmerman’s claim of self-defense has enough merit to obviate the need for a trial. In this hearing, the state needs to do nothing more than make a prima facia case of Zimmerman’s guilt. Zimmerman’s attorney must show a preponderance of the available evidence favors the conclusion that Zimmerman acted in self-defense. If this can be shown, then the case is dismissed. If not, then the case proceeds to trial and the hurdle a self-defense claim needs to clear becomes somewhat higher.
