Well, there’s some question as to how much of an effort the photographer made to help the guy. Plus, he could have not submitted it to the paper at all.

1st, not sure if it was a professional photographer or just someone waiting for the train with an I-Phone
2nd, iirc, if it was a pro and he works for the paper they ‘own” any images he takes
3rd, whoever submitted it, it still comes down to an editorial decision
4th, from the distance of the train (and it’s approach speed) I doubt anyone, unless they were right in front of the poor guy, could have done anything for him
