Last I checked, you can’t bring in new evidence during appeals. And certainly not evidence that is irrelevant to the appeal being heard. IOW, you can’t use an appeal on a minor matter as a trojan horse for a case that the courts already put the kibosh on.
I think you can in cases where the evidence has newly come to light since the final judgment was issued. That may also only be in criminal cases; as always, IANAL.
