Amnon Bundy’s latest motion to dismiss.

“COMES NOW Defendant AMMON BUNDY1
(“Defendant”), expressly admitting the
personal jurisdiction of this court2
, and pursuant to Rule 12(b)(2) and Rule 47(a) of the Federal
Rules of Criminal Procedure, respectfully moves for an order dismissing all counts in the abovecaptioned
matter, for the Court’s lack of subject matter jurisdiction.”
The argument presented here is straightforward: The Constitution of the United States prohibits the federal government’s ownership of the land comprising the Malheur National Wildlife Refuge. Since the land is not lawfully the federal government’s, the pending counts must be dismissed for lack of subject matter jurisdiction.
