Wong Kim Ark in 1898 addressed birth on US soil, but only in the context of diplomats and others posted here (they don’t get citizenship). Birthright citizenship has been interpreted by the XIV Amendment to extend to everyone born here, but has never been litigated. It could bee overturned.

Then there is the treaty we’re a signatory power to:
The American Convention on Human Rights similarly provides that “Every person has the right to the nationality of the state in whose territory he was born if he does not have the right to any other nationality.” (Wikipedia)

We would either have to withdraw from the treaty (every nation in the Americas is a signatory except Venezuela), or claim that people born here have a right to citizenship elsewhere. (Poland isn’t going to take me.)

The United Nations views birthright citizenship as necessary to reduce the numbers of stateless people, who often have no rights. Since we’re not on the Human Rights Commission, I guess that doesn’t matter to the GOP.

One wingnut claim is that no country other than the USA offers birthright citizenship, which is an outright lie.
