That’ll come into play too, but it’s possible someone will try a products liability tact - defective design that they knowingly went with that had underpowered backup systems (IOW - attempt to pursue a strict liability, rather than negligence case).

Also true. And most likely they’ll try to shotgun all of them (plus some more esoteric challenges) into the case.
