What if the R’s did it tomorrow?
I think there’s an argument to increase the size of the Court to 13, one Justice for each Circuit (or even just to 11 if you don’t want a Justice for the DC and Federal Circuits). In a rational world, the tacit agreement would be that expansion would happen with a presidential election in the middle, so the current president gets two picks, and then whoever wins the intervening election gets two picks. And I said a “rational world” so that would exclude a Trump presidency. There was a time, after all, when the Court only had five members, and then seven, before the nine we know know.
