Constitution Meant to Be Interpreted (Goes to the Scottsbluff, Nebr. Star-Herald)

To the Editor:

Mr. Boyd Dohse wrote on Dec. 5 that the Founders did not intend the Constitution to be interpreted. That of course ignores the Constitution has a Judicial Branch, which does exactly that, along with an amendment process that has been used to strike large portions of the Constitution (notably slavery and Native citizenship, women’s right to vote, etc.).

Regarding the issue he wrote about, the Second Amendment and the DC vs. Heller Supreme Court decision, which (ironically) interpreted the Second Amendment, that decision did not strike down all regulations regarding firearms. It struck down banning an entire class of firearms (pistols), while noting that jurisdictions could still ban other classes (machine guns, for example).

As for people “not being able to own firearms” under British rule, that is simply untrue. There was no massive smuggling operation to arm colonials so they could hunt prior to the Revolution.
