The case was returned to a lower court so the man can re-argue his sentence.

The three most conservative justices were the ones who didn’t see a problem with the sentence (Thomas, Alito, Gorsuch).

Thomas said the court decision was “no profile in courage” and that it would “delay justice for the victim.” (In the unlikely event I was murdered, I don’t want anyone executed in my name as so-called “justice.” I’ve had this discussion with my wife, who favours the death penalty. I consider it morally repugnant, particularly if the wrong person is convicted.)
