As far as I can tell, the court decided in favor of the convicted man. Those three dissented.
Thatās correct.
The case was returned to a lower court so the man can re-argue his sentence.
The three most conservative justices were the ones who didnāt see a problem with the sentence (Thomas, Alito, Gorsuch).
Thomas said the court decision was āno profile in courageā and that it would ādelay justice for the victim.ā (In the unlikely event I was murdered, I donāt want anyone executed in my name as so-called ājustice.ā Iāve had this discussion with my wife, who favours the death penalty. I consider it morally repugnant, particularly if the wrong person is convicted.)
