Moreover, a person being elected to office does not give up his or her right to private E-mail or letters. That was the whole of the claim wingnuts were trying to make over Hillary Clinton’s “missing” E-mails (her private mail she was not required by any law to turn over).

There is an issue unique to the president and White House staff under the Presidential Records Act. Yes, they are entitled to keep private email and documents, but a lot of their documents may fall into the categories of documents that are governed by the act. The fact that they are using systems specifically designed to circumvent the law (as there’s no evidence that email or documents were archived) is very much a problem.

It is also a problem if documents are being hidden/destroyed so that a review of whether they qualify under the Act can be conducted.
