The more I read into the Jean case, the more convinced I become that the charge of manslaughter is not just them giving her a wrist-slap, it’s a strategy to lower the bar for the jury to hop over. There reportedly are two witnesses who heard a verbal exchange before the shots, which is probably why she suddenly charged her story from “saw intruder and shot” to “shot intruder after he refused lawful orders.”

If she’d simply shot him, they could spin it as “She feared for her life and took immediate action” and beat a murder charge. She spends a few weeks going through post-shooting therapy and retraining while riding a desk before getting her gun back.

But if she’s yelling “Get on the ground!” and he’s yelling back “This is my apartment!,” there’s enough time for her to realize her mistake and safe her weapon. So now they have to say “Well, it was a total mistake,” hence the massaging of her story to say she didn’t realize she had the wrong apartment until 9/11 asked for her address. But even that story is hard to believe, considering she lived 3 stories above him, their apartments are not going to be furnished in the exact same fashion, and (most importantly) she has a dog that wasn’t making a shitload of noise at this “intruder.” If she wasn’t impaired (which would be a no-no if she was in uniform), then she should have been clearheaded enough to recognize at least one of those facts before she shot him.

I don’t think the blood work is back yet. You’re right, it’s a no no, but…….
