Anybody understand how anyone in the military can ‘refuse’ to follow an executive order from the CinC?

I’m no lawyer, tho know a bit about the UCMJ (Heh). IIRC, these military tribunals were approved and AUTHORIZED by both the Legislative and Executive-and SCOTUS hasn’t ruled them unconstitutional. If there is actual legislation for these tribunals, BO can’t just order them out of existence, not as CIC or POTUS. Yes/No?
