And if the former, do you think he would have been found guilty without SYG?
Illinois does not have SYG, James. But “duty to retreat” never applies inside one’s own home (this is the “Castle Doctrine”). So no, James, the homeowner would not have been charged, with or without SYG. In a case like that, inside one’s own home, a reasonable belief that one is under imminent threat is enough. The law does not require that a citizen wait until the threat is proven beyond doubt.
