So keeping it in the court/legal realm, you agree as a lawyer that photo was thin proof of touching/groping and could be sold as nothing more than a stupid prank.

That was what I was hoping when I made the bad crack about you being a lawyer. I was hoping you weren’t saying you could build a case around that image. I’d be calling in some of the others on the plane like the photographer and the people in the immediate area. And of course question Leeann about timing and other images after the incident, etc.

And that is what is sad about the political end of it. The whole thing started on the image and the kiss and there is serious contention of the actual details of both.

And yet, it was more than enough to have many call for his resignation.

The problem with that defense is that in questioning Franken the other side can throw Franken’s own words back at him about how degrading the photo was. Then we’d move on to the other seven women who have accused him, assuming more didn’t come forward. It would be a complete shitshow, which is why Franken decided to resign.
