Ok, so quick thoughts on the border wall decision:

First, the dissent is really a “we don’t have authority to review this case” dissent, and not a dissent on the merits. the reason for that dissent is because the law at issue, the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 has a provision that certain appeals have to go directly to the Supreme Court (which is probably right, but also slightly irrelevant since the decision would likely still be taken up to the Supreme Court).

Second, the IIRIRA (stupid, I know), basically allows the DHS to waive whatever laws it wants to in order to build a fence/wall/barrier on the southern border:

Notwithstanding any other provision of law, the Secretary of Homeland Security shall have the authority to waive all legal requirements such Secretary, in such Secretary’s sole discretion, determines necessary to ensure expeditious construction of the barriers and roads under this section. Any such decision by the Secretary shall be effective upon being published in the Federal Register.

That seems like an incredibly stupid bit of legislation. Which makes sense, since the 90s was full of a lot of incredibly stupid legislation.
