This may be a bit of a stretch, but those wedding cake toppers with the little figure of a bride and groom on top don’t come in same-sex versions, so a bakery could legitimately say they can’t provide a topper for a gay wedding cake.

To be honest, I think we should recognize that businesses can, and in fact *should* discriminate, legally, in some cases. For example, it’s acceptable (and may in some cases be mandatory) to refuse to serve alcohol to someone who is already intoxicated. It’s also mandatory to refuse to sell alcohol and cigarettes to minors.

On the other hand, there are cases where discrimination is illegal. I cannot refuse to set up a house sale on the basis of race, for example.

This current situation is, broadly speaking, about establishing whether or not it’s illegal to refuse to sell wedding services to gay couples. I’m not 100% unsympathetic to the religious exemption argument, but I think that the rights of gay people trump the right to “run a Christian business” (whatever that means).
