Sotomayor’s dissent is very well reasoned and it make little sense for the Court of Appeal to stay a permanent injunction after it allowed a preliminary injunction to continue in place and the trial court finding that plaintiffs’ satisfied all their burdens of proof.

Without seeing the Court of Appeal decision, or knowing the issue on appeal, this seems like a very bad decision. But I suspect a lot of it has to do more with procedural issues than the constitutional issues at play.
