What argument will Trump’s lawyers use now to delay?

They get to avoid having this decided before November. That’s a win for Trump.

In these tax cases, the District gets to rehear on the Congressional powers and they have to focus on separation of powers arguments this time around, while the Vance case will move ahead and Trump can try to run out the clock until after the election.

In some sense, Roberts punted both cases without ruining the Court’s independence. Trump isn’t entirely above the law, but justice delayed is still justice denied. Trump gets to exploit the delays.
