Sure you are, because now you’re raising the bar. Once he’s criminally liable for any actions taken by the end-user, then you have to treat him as accomplice. That means he not only has to prove he fulfilled his obligations by running a background check, now you’re probing into whether he was helping the guy pass said check. Now it’s not only the check, it’s whether or not he sold to a guy he thought might be up to no good. A lot of this is subjective and a lot of it is going to get him treated like a criminal.
