No, not really. The fact that the Kansas law is that much worse doesn’t change things at all. The existing laws exempts churches and religious orgs only. 1062 would exempt anybody, any business that claims a religious basis for their discrimination. So what if it carves out a space for compelling state interests, that just leads to a ton of bullshit litigation. Do we really want local state civil juries trying trying to figure out the compelling government interest difference between a muslim restauranteur’s objection serving gays vs. blind people with service dogs?
