That’s just Fischer tweeting about an NRO article by the far more sensible Kevin D. Williamson. And Williamson does have some ground to stand on:

In the Miller case of 1939, the Supreme Court ruled that the 2nd Amendment did not overturn local firearms laws on short-barreled shotguns or the National Firearms Act because a sawed-off shotgun was not the sort of weapon a well-regulated militia would use.

In the Timothy Joe Emerson case within the past decade, the 10th Circuit Court of Appeals ruled that Miller was not on point in its decision because the Model 92 Beretta that Emerson owned was exactly the sort of gun a well-regulated militia would use, in as it is issued by both the US and French armies.
