Why would anyone agree to testify before congress if there are no penalties for not doing so?

No inherent contempt powers - Congress has to rely on a referral to prosecutors who then have to make a determination to even bring to a grand jury who may or may not agree, and that all takes time. And the worst that can happen is an effective slap on the wrist.
