So Trump has fired (another) cabinet member and replaced him with somebody who has already gone through the confirmation process in order to avoid another round of confirmation hearings?

That provision of the law needs to come under direct scrutiny as Trump has obviously found another way to avoid the constitutional requirements of advise and consent via loopholes
