Actually, it’s entirely possible that this gets upheld. Plaintiff published his photo (and there’s no dispute that he owns the copyright), and Defendant used it without the proper consent/license, and did so for a commercial purpose.

Copyright law isn’t my area of expertise (I know just enough to be dangerous), but reading the ruling, I think it’s on pretty solid ground.
