That’s the only legal way they can force a halt to the proceedings.

The military chain of command does not have the legal authority to tell a military judge how to proceed in his own courtroom.

Military judges, other JAG officers, chaplains, inspectors general, and medical officers have considerable leeway and independence in the course of their duties. Yes, they are subject to the orders of their superiors, but not with regard to how they handle individual cases.
