I note in the statement that even if an American stationed overseas came home and had a child here whilst taking regular leave, living in their own property, the child would still not qualify.

In that circumstance the child wouldn’t qualify under INA 320. It would instead qualify by virtue of the 14th Amendment, due to being born inside the actual territory of the United States. Remember, the whole fucking thing was written by lawyers and bureaucrats, who aren’t in the goddamned business of making shit understandable.
