Okay, not to piss on anyone’s dreams at this point, but the most likely outcome is that Trump nominates and the Senate confirms. Doesn’t matter, for the sake of the seat, whether the confirmation or indeed the nomination happen now or after the election.

That doesn’t mean the Dems don’t fight, but our ability to stop this is severely limited. I’m not sure at this point that we should threaten to expand the Court if we win, because we can always do it anyway, and in the unlikely event that it got McConnell to relent, we’d be stuck keeping our promise.

No, I think we should grieve and move on.

Trumps best argument for reelection with a lot of Republicans will be gone, though. They aren’t given to gratitude, so the fact that he filled the seat won’t matter as much as making sure he would fill the seat did. So, there’s that.

I think the GOP underestimated the FURY that the Kavanaugh confirmation triggered. They thought it was a positive for them, and would energize their base, but what it REALLY did was energize ours. Similarly, another naked display of power will pile more fuel on the fire of our fury. I remember Roosevelt’s phrase - “The American People in their righteous might…”
