I think if the Supremes decide the case before a ninth judge is confirmed, the decision would be either 6-2 or 7-1 in favor of upholding the 9th Circuit decision. Roberts and Kennedy would likely go along with the majority, and I think the odds of Thomas concurring would be 50-50. Alito of course would be 100% in favor of whatever the shitgibbon wants.

I have a hard time believing that *any* SCOTUS justice would yield the power of their branch of government.
