The flip side of that, of course, is that a solidly blue Congress in lockstep with a Biden White House could do a lot in a disciplined two years to turn more of these court-decided landmarks into solid legislation that even a 6-3 SCOTUS would have a hard time overturning.
I also remain stubbornly optimistic that a D-controlled Congress will investigate the shady circumstances around Kennedy’s resignation and Kavanaugh’s debts. I believe there’s something there that just maybe could force him off the court.
I doubt there is anything that could be dug up that would force him to leave the court voluntarily.
