re: #320 Feline Fearless Leader

It looks like we’re in a place where the Executive Branch has more power than the other two branches can deal with (or want to deal with). If enforcement relies heavily on the DOJ and the AG is complicit with the violations than we seem to be in the place where the President can say to Congress (or the courts) “and what do you plan to do about it?”

When I was in law school, I noticed in almost every class that legislation was passed right after Nixon’s administration to deal with all the stuff he did. It was like scar tissue through the statutes and regulations and court holding of the time. He had done so much bad shit that people hadn’t thought to make illegal before - the president can’t pull up enemies’ tax returns, e.g.

If somehow we get through this, a whole bunch of new laws and regulations and court holdings will again be necessary. Emoluments. Congressional subpoenas. Releasing tax returns. Nominating people so the Senate can do it’s job advising and consenting. Putting people in concentration camps. Stealing people’s children. Election fraud.

Some of these things were just custom (we only thought they were required). Some are in the constitution but there’s no enforcement mechanism. Some are illegal, but not enforceable once the justice department has been coopted. Major, comprehensive changes have to be made if we are going to save our democracy. I’m really afraid that they won’t and we won’t.
