“Illegal entry” into the United States is not a crime, it is a civil offence. The penalty is deportation.

What is a crime is bypassing a customs house to avoid making customs declarations. That is a felony.

Perhaps, though, it should be a crime. That way, at the very least, those accused of such would get the protections of Article III courts and have the right to counsel, rather than the shit show of administrative proceedings they get now.
