As far as I know, this is another one of those things that he can’t do but likes to think he can. The Posse Comitatus Act requires congressional approval to override. He’s not going to get that. State governors can use the National Guard without PCA issues, but only under certain circumstances. Supreme Court case precedence has had “Civilian courts completely unable to operate” as a bare minimum requirement for martial law. I don’t see that as a thing in any jurisdiction right now.

He can try to just decree this but it wont happen. He can try to order war crimes. I fucking dare him to try that shit right now.
