Perhaps, though, it should be a crime. That way, at the very least, those accused of such would get the protections of Article III courts and have the right to counsel, rather than the shit show of administrative proceedings they get now.

Very few nations make it a crime because crimes generally come with jail time if you’re convicted. It is much cheaper to deport someone.

Asylum claims are not crimes and a court hearing is part of an asylum claim.
