A lot of states have “sore loser” laws that prevent someone from running third party if they stood in the primary (though I don’t know if those laws also apply to the presidential race). Gary Johnson is running for the Libertarian nomination and will probably have it - let’s be honest, there isn’t a republican candidate that could convince Libertarian delegates that he’s really on their side. The constitution party, though… Maybe

If they get 5% of the vote they qualify for federal matching funds the next time around, so it would be worth it to them. Except, of course, they probably think federal matching funds violate the Constitution!
