I mentioned the other day that litigating cases in public is a dangerous game. Avenatti’s decision to go public with these documents, at this time, is not the decision I would have made. In part because it exposes him to having to answer the question of how he got them. And in part because it is always much more fun to surprise the other side with information like this in a motion (or deposition/discovery setting) that they aren’t prepared for rather than on TV, and giving them the chance to go to the judge to accuse you of bad acts.
