It’s just lazy and I blame Scalia for legitimizing it. Scalia wasn’t a stupid man but I do think his judicial philosophy was both lazy and hypocritical- see his votes on Lawrence and Obergfell in which he let his pre-existing biases against LGBT people override the 9th amendment.

IANAL but that was the decision that led me to lose all respect for Scalia and to reach the conclusion that a person’s heart was more important than their mind in deciding who should serve on SCOTUS. I read the dissenting opinions of both Scalia and Thomas. While I disagreed with Thomas, his opinion was sane and logical given his philosophy, and expressed in acceptable moderate language. OTOH Scalia issued an offensive screed with objections based on fanaticism and not the law. The last thing we need on the court is another lying religious fanatic and Scalia clone who is guided by theocratic principles and RW ideology.
