Come on. The one and only reason prohibition is not the law of the land is that it was explicitly repealed.

Also, if we were to really have a bias for the first ten amendments over the later amendments, what do you say to the aggrieved slaveowner that argues his rights to his property under the bill of rights are infringed by the 13th amendment?
