Tilting at neocon windmills. Every challenge to affirmative action has failed in the courts, because the white litigant generally was a weak candidate to start with, IIRC.
This has been a windmill since I was in college, and that was a while ago.
(I’m a year away from my 40th reunion. Sigh.)
SCOTUS is conservative enough to kill affirmative action if they get a sufficiently appealing fact pattern, IMO.
So it all depends on when/if they can find a better plaintiff than another ‘Becky with the bad grades.’
