As I noted a few days ago, Ms. Daniels executed an elegant checkmate by offering to return the $130,000.
If they take it, then they have admitted there is an NDA. If they refuse it on the grounds โthere is no NDA,โ then she is free to speak.
If they try to sue (ignoring lying about an NDA), then they are opened up to discovery. Michael Cohen claimed he paid her personally (which my poor understanding of the law means he could be disbarred). No matter where that goes, they are opened up for the discovery process in a lawsuit.
