Well, it depends on the goal of the legislation. It sure doesn’t seem like we legislate to prevent in this country but legislate, instead, to punish. So I’m not sure folks even expect a law to stop behavior, they just want a way to punish you. Penance model.


There are forms of morality we need to legislate, such as murder, rape and theft. But acts between consenting adults are another matter, we have no business wasting time and rewourhese acts very clearly fall under my definition of “the pursuit of happiness”, this being a fundamental right of all humans.
