Heart of gay marriage law unconstitutional, appeals court rules

The 1st U.S. Circuit Court of Appeals in Boston said the Defense of Marriage Act, which defines marriage as a union between a man and a woman, discriminates against married same-sex couples by denying them federal benefits.

The ruling itself is rather dull and exactly what you would expect. At this point opponents really have no excuse for making a big deal about these lower court rulings on DOMA Section 3, since the vast, vast majority of the federal judiciary would rule the same way. Under existing Supreme Court precedent it is nearly impossible to come to any other conclusion besides ruling it unconstitutional. Now, the Supreme Court can always decide otherwise, but lower courts don’t have that luxury.
