Interesting article.

It has been impossible for me to take “states rights” etc. seriously as an intellectual argument ever since I realized that in US history, this point has had widespread traction in only two cases:

1) Nullification etc. in the South in the pre-Civil War era.

2) State-level resistance to Federal civils rights and desegregation actions in the 20th century.

QED.

States rights are complete bullshit once you realize how many times the South had the Federal government back their states rights over the rest of the Union.

Same thing as gay marriage. They want it to be Federal law if they can ban it, but if it looks like its allowed, they want to make it a state issue.
