It would seem like they have enough to establish elements of subsection (1), and they might even have been able to invoke the enhanced penalties. So, really, it doesn’t make sense, and I’d be curious as to what the calculus was in this decision.

The code and the law really don’t matter because they weren’t criminals ‘breaking the law’.

They were setting up their own laws, courts, and system of government up there in Oregon in their area of control.

As I argued at the time, that is not criminality, it was a direct attempt to overthrow the sovereignty of the United States and replace it with their own form of government. This should have never seen the inside of a civilian courtroom. They were not criminals, they were enemy combatants and I feel they should have been treated as such.
