The thing is, the shooter was acquitted of both murder and manslaughter charges because the jury rightly saw that the shooting was an accident. The “illegal immigrant,” a homeless guy, found a rag under the bench he was sitting on and took a look. The rag was wrapped around a gun. As he unfolded it to see what was inside, the gun fired. The bullet hit the surface of the wharf and ricocheted sixty feet before hitting Kate, the tourist walking on the wharf. Even if for some reason he had meant to harm her, he would have had to be the greatest trick shot in history to pull this one off.

And yet the wingnuts still harp on this case as justification for persecuting immigrants.
