2. Its happening probability is very low and the probability that torture will help is low.
3. Legalizing torture would open door to abuse. (Let’s omit all the moral factors.)
4. So what Dershowitz proposes is unlikely to help but is likely to be abused.

They don’t make fuzes long enough, or clocks slow enough, to permit LE and judicial response. It’s an inherent disadvantage of police and military command processes that there will never be enough time to react to any information.
